General Terms & Conditions
This English text is a non-binding convenience translation. The legally binding version is the German original; in case of doubt, the German version prevails.
Read the binding German version →§1 Scope and contracting party
These Terms & Conditions apply to orders placed through this online shop in the version valid when the order is placed. Your contracting party is Marcel Kartolo, sole proprietor trading as “Lelumáré”, Speditionsstraße 15a, 40221 Düsseldorf, Germany, email: shop@lelumare.com, phone: +49 15679 830611.
§2 Conclusion of contract
Product displays are not binding offers. By clicking “Order and pay”, the customer makes a binding offer. We accept this offer in the order confirmation sent by email; the contract is concluded upon dispatch of the goods at the latest.
§3 Prices and shipping
All prices are final prices. No VAT is charged or shown under § 19 UStG (German VAT law). Additional shipping costs depend on the destination, carrier and delivery method and are displayed before the order is placed. We deliver within the European Union only, excluding the areas outside the EU VAT area listed on the “Shipping & Payment” page. The shipping cost table and delivery information are available on the “Shipping & Payment” page. For pre-orders, the maximum delivery time shown before ordering applies in calendar days from the order date, including replenishment and shipping. It is recorded in the order confirmation.
§4 Payment
Payments are processed via Stripe. The payment methods available for your order are displayed at checkout.
§5 Retention of title
The goods remain our property until payment has been made in full.
§6 Right of withdrawal
Consumers have the statutory right of withdrawal described in our withdrawal policy. The policy and model withdrawal form are included in the order documents sent by email.
§7 Statutory warranty and applicable law
Statutory rights concerning defective goods apply. For new goods, the statutory limitation period for defect claims is generally two years from delivery. Subject to statutory conditions, consumers can request remedies free of charge (repair or replacement) and, where applicable, a price reduction, termination and damages. Complaints and defect reports can be sent to the contact details in §1; using the online returns function is optional. German law applies. For consumers, this choice of law does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence where that law would apply without a choice of law under Article 6(1) and (2) of the Rome I Regulation.
§8 Contract language and records
Checkout is available in German and English. The German version of these terms prevails; the English version is a translation. Mandatory consumer rights remain unaffected. We store the order data and email the order documents, including these terms. Before placing the order, you can review and correct your entries using the checkout fields and Back function.
§9 Consumer dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
